Rizz Dial provides a robust platform for managing outbound calling and texting operations. Our features include predictive dialing, local presence, spam protection, CRM integrations, reporting dashboards, and customizable automation workflows for sales, customer service, and lead generation.

1.3. Third-Party Services

The Services may include integrations with third-party services. Rizz Dial is not responsible for the functionality, accuracy, or reliability of third-party systems.

2. User Responsibilities

2.1. Compliance with Laws

You agree to use the Services in compliance with all applicable local, state, national, and international laws, including:

Telephone Consumer Protection Act (TCPA)
Do-Not-Call (DNC) Registry Rules
Telemarketing Sales Rule (TSR)
Anti-fraud and privacy laws

2.2. Obtaining Consent

You must obtain prior express consent from all individuals contacted using Rizz Dial’s platform. You are responsible for maintaining and retaining records of consent for at least five (5) years.

2.3. Prohibited Use

You shall not use the Services to:

Send unsolicited or spam communications
Forge or falsify consent data
Violate applicable telecommunication laws
Engage in illegal, abusive, harassing, defamatory, or fraudulent behavior

Violation of this section may result in immediate termination of your account and legal action.

2.4. List Management

You are required to:

Scrub your contact lists against the DNC registry every thirty-one (31) days.
Verify that all uploaded contact information complies with applicable laws.

3. Payment Terms

3.1. Fees and Charges

Service fees are billed on a subscription basis. Pricing details are provided at www.rizzdial.com/pricing. By subscribing, You authorize Rizz Dial to charge Your payment method for all fees.

3.2. Late Payments

Accounts with unpaid balances may incur late fees of up to 10% of the overdue amount. Rizz Dial reserves the right to suspend or terminate Services if payment is not received within fourteen (14) days of the due date.

All payments are non-refundable unless explicitly stated otherwise in writing.

4. Acceptable Use Policy

4.1. Prohibited Activities

You may not use the Services to:

Send deceptive messages or alter caller ID information
Conduct illegal telemarketing activities
Engage in activities that disrupt Rizz Dial’s systems or other users’ access

4.2. Monitoring and Enforcement

Rizz Dial reserves the right to monitor Your use of the Services to ensure compliance with these Terms. Rizz Dial may report suspicious activities to relevant authorities.

5. Data Privacy and Security

7. Termination

You may terminate your subscription at any time by providing written notice. Termination will take effect at the end of the current billing cycle.

Rizz Dial reserves the right to terminate or suspend Your account for violations of these Terms or non-payment.

8. Indemnification

You agree to indemnify and hold harmless Rizz Dial, its employees, affiliates, and agents from any claims, damages, or liabilities resulting from:

Your use of the Services
Your violation of these Terms
Your violation of applicable laws or third-party rights

9. Limitation of Liability

To the maximum extent permitted by law, Rizz Dial’s liability for damages shall not exceed the amount You paid in the twelve (12) months preceding the event giving rise to the claim. Rizz Dial is not liable for indirect, incidental, or consequential damages.
